Posted September 21, 201113 yr To whom it may concern, on 09 21 11 @ 2:57pm southwest towing was dispacthed to an SMPD small wrecker rotation arrest at same club parking lot, when the 1ton small wrecker that was requested arrived at 301, SMPD dispatch called and stated a heavy wrecker maybe needed, at that point a heavy wrecker was dispatched, at 303 Pm at 318 the heavy wrecker was canceled as it arrived on location. The small wrecker that was dispatched was the canceled as well, AFTER the SMPD inventory was completed and signed by the southwest towing driver, i Jonathan phillips asked mr crook , why both my wreckers had been canceled, he stated that the customers showed up, and no wrecker was needed, i explained to him that my wrecker had already been there for 20mins, and the inventory was completed and the rotation vehicle was already in our possession, he told me that i was wrong, and my wrecker never hooked up.. and the customer was not going to pay me. nor was the city going to write me a check, i explained to him that the wrecker that SMPD requested CAN NOT hook up to a truck that size, and thats why a big wrecker was requested at a later time, and that the fault layed on SMPD for requesting the wrong size truck. and my small wrecker was on scene and needed to collect a SMPD NON CONSENT TOW SHOP UP FEE... he told me that i was wrong. i explained to him that these mistakes cause time and money, they asked for 2 tow trucks, 2 drivers, and it cost money to fuel both trucks! " he responded , so what i dont know what you want to do about this your on top of rotations for both wreckers, i explained that we need to figure out a way to avoid these issues in the future, i then asked him if he were a business owner he would under stand why this is a costly mistake, he responded " i would understand thats the cost of doing business and thats the type of business im in.. .. i walked away. as he knows NOTHING about the wrecker business i then called my small wrecker driver and asked him to relay a question to MR crook for me.. my question was. " what is the Purpose of a show up fee. if i can not collect it when my wrecker shows up" mr crook responded, " tell him im NOT going to get into this " then stated " if jon is so worried about his fuel then tell him ill meet him so where to do an inspections on his wrecker.".. as to threaten me. these kinds of mistakes cost money cause confusion and hurt the relationship of SMPD with wrecker companies. simple questions were asked, and i received no answers from the man that is in charge of SMPDs towing regulations . when a towing company has a question about operations.. and received a response of " im not going to get into this " Then WHO and WHERE do i need to go to find some one WHO is going to GET INTO IT? i have searched for the ordnance that covers show up fees with no luck, for a electronic version of a non consent tow schedule http://library.municode.com/index.aspx?clientId=11549&stateId=43&stateName=Texas Sec. 90.290. - here is a paragraph from your ordnance :. It shall be unlawful for a wrecker service or wrecker driver to charge a vehicle owner a show up fee unless the wrecker was dispatched from a remote location for the purpose of towing a specific vehicle. This subsection does not apply if the vehicle is disabled or is being impounded by a peace officer, or if the vehicle owner is disabled, has been arrested, or for any other reason is unable to operate the vehicle.
September 21, 201113 yr Author i just firued out ALOT of people here wont read somthing that long, and even if they do they wont understand why im so hot.. or even care. i more or less posted it here for proof reading.. sometime it makes sense to me but not to anyone else.

Little stuff like not capitalizing I and not using apostrophes can make people not take you as seriously. Also did you mean "To whom it may concern"? Not trying to be a dick just help you out.

It's hard to balance professional and pissed haha yes sir!! and im known for being a hot head, even the cops know ill do anything to get my point across even if im wrong. prolly not the best thing to be know for but its on the list!!! among alot of other things.. its kind of a small town and im a big guy
September 21, 201113 yr Have a letter written by a lawyer sometimes works wonders, gets the point across much faster, that your serious, often times people will end it right there to avoid court.Good luck.

September 22, 201113 yr Bummer of a situation. I'm not in the wrecker business, but I would expect that if the SMPD request a wrecker, the second the wrecker shows the wrecker driver would have the officer at the scene sign, date, and time stamp some sort of report. With that you can easily send the city a bill. Other than that it's just gonna be politics, the good ol' boys club of scratch my back and we'll see if I shoot crumbs your way. It's the world we live in, sadly. A lawyer will help, but it's a sure fire way to get you kicked out of the good ol' boys club if you know what I mean. :/ If you're game for some politics take Mr. Cook on his offer and meet him. Nothing like a little face to face to let someone know who they are dealing with. Men in charge dig that sort of feistyness, it's a sort of reminder of when they were young sort of thing. One thing though, don't show up if the wrecker isn't up to code. One other route, and don't quote me on this, but I think the wrecker industry is regulated by the railroad commission. You can try getting a hold of the local rep for the railroad commission and rub elbows with him and see if he'll put the squeeze on Mr. Cook. Good luck bro, the main thing is to convey to them that you are a small business offering a service that is dependent on payment for all services rendered.
September 22, 201113 yr Author dudes not even a cop, im not asking for anything that is not in the ordinance , if i have to follow the rules.. then why dont SMPD, towing is now regulated by texas department of licance and regulations ..i guess the local Pd does scratch my back a little. music wise, and maybe speed wise from time to time, shit who knows what else... but none of that has anything to do with crook,.. hes not even a falkin cop!
