Oh boy....... they just passed the "no helmet required" law in my state a few days ago.

Odd, I had a guy who's 'son won an auction he was not given permission to bid on'.

Told him I want my listing fee's and its good to go.

I think it would mostly depend on the value of the object. If it was less than $100 then I would expect the seller to be compliant with you; but if it's a big hit item you might get stuck with negative feedback. I won a bid for an item of which I didn't read the description well enough and discovered I didn't need it. It was only $20 and the seller just feed me for the listing and it was all good :)
